Litigation in Saudi Arabia is complex and there is no substitute for real experience within its courts. The main method of resolving commercial disputes in Saudi Arabia remains litigation even though arbitration is now possible and its procedures are advanced. The litigation system is inquisitorial and the judge will request the claimant to proceed with evidence or proof based on its claim, and then hear the defendant\u2019s evidence to the contrary. A judge decides the outcome. Evidence must include written evidence such as documents and contracts. The Saudi Arabian Ministry of Justice (MoJ) implemented extensive e-litigation services that facilitated litigation proceedings during the pandemic period which remain in place. <\/span><\/span><\/p>

Saudi Arabia has recently issued a new Companies Law which will govern all forms of entities in the Saudi market, whether commercial, non-profit, family operated entities, and\/or professional, under one comprehensive single law. The new Companies Law is aimed at modernizing the country\u2019s corporate legal framework and attracting foreign investment. It brings in various company-related regulations within a unified legislative format and is part of the country\u2019s efforts to modernize and reform its commercial and investment laws. Having worked with the previous regime, seen the evolution whist in practice, we are uniquely placed to advise on all aspects of corporate law in Saudi Arabia whether it is inward or outward investment or investment within Saudi Arabia. <\/span><\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t
